By using the web site RoseDog.com you (sometimes referred to as the "User" or "Users") agree to be bound by the following Terms of Service which may be modified from time to time.
RoseDog offers posting of unpublished work only in its showcase. Published work may however be displayed for sale in the RoseDog bookstore. RoseDog reserves the right to remove from the site any submission, for any reason, at its total discretion and without notice. RoseDog reserves the right to reclassify material submitted to its showcase at any time, at its total discretion and without notice.
Users are cautioned that any unauthorized submission or distribution of copyrighted or proprietary content is strictly illegal and may subject the User to criminal prosecution and/or personal liability in a civil suit.
RoseDog.com is not responsible for the content of material posted to its showcase or bookstore and may through its automatic and manual posting procedures edit any text, graphic or other file posted to its showcase in order to modify its physical appearance in the showcase, including but not limited to inserting paragraph breaks, or reducing the size of graphics.
By using the site RoseDog.com, you agree not to post illegal material of any kind, including but not limited to, illegal material in the form of text, graphics and other files that infringe any third party's copyright, patent, trademark, trade secret or other proprietary rights or rights of publicity or privacy. You also agree not to post material of a defamatory, libelous, hateful, offensive, harmful, inaccurate, misleading, deceptive, obscene or pornographic nature, or material that violates any law, statute, ordinance or regulation in any way.
By submitting material for posting on RoseDog.com, you assume all risks associated with public display of the material and you attest that you own legal rights to that material and indemnify RoseDog.com from all legal liability for copyright infringements. You retain all rights to your work, but grant RoseDog.com permission to display material you submit to its showcase on its site until such time that you remove the material from the site.
By submitting material for posting on RoseDog.com on behalf of clients, Users who are acting as agents or representatives of writers attest that the writer-client owns legal rights to that material, that he or she has received express permission from the owner to submit the material on his or her behalf, that the owner assumes all risks associated with public display of said material and indemnifies RoseDog.com from all legal liability for copyright infringements. The agent or representative also attests that the writer-client grants RoseDog.com the royalty-free license to publish said material to the public worldwide on its site until such time that the writer-client or agent / representative on behalf of the writer-client removes the material from the site.
You are cautioned that material posted on RoseDog.com may contain adult language and content, and parents of young children should read all material before allowing children to access it.
RoseDog.com offers an interactive environment enabling Users to express themselves and share their ideas through a proprietary messaging system. Users assume total responsibility for the content of such messages, and for any direct or indirect consequences of such messages.
Users agree not to send messages containing material that is defamatory, libelous, hateful, offensive, harmful, threatening, inaccurate, misleading, deceptive or obscene in nature, or material that violates any law, statute, ordinance or regulation in any way. Any User aware of transmission of such messages is asked to inform RoseDog.com at rosedog@stargate.net
You are responsible for maintaining the confidentiality of your password and may not disclose or share it with third parties, or use it for unauthorized purposes. You are responsible for all uses of your registration, whether or not authorized by you and agree to notify RoseDog.com at once of any unauthorized use.
By registering with RoseDog.com as a literary agent or publisher, certain Users attest to their authenticity as a literary agent and/ or publisher. RoseDog.com has no control over the truth or accuracy of such attestations and notes that there are risks in dealing with persons acting under false pretense.
In addition, writer members post their work on RoseDog.com in the hopes that they may be offered a contract with a trade publisher. Therefore, we do not permit any publishers to register who require writers to finance their own publication, in total or in part. Only registered agents and publishers may contact writer members for business purposes. However, writer and reader members may use the proprietary email to comment on manuscripts, and are encouraged to do so. See the guidelines above.
RoseDog.com facilitates through its messaging system contact between authors and members registered as literary agents and publishers. RoseDog.com makes no warranty as to the results to be obtained from use of this or any of its services, and assumes no liability for the quality or results of any discussions and/ or transactions between authors, agents and publishers. In the event that a User has a dispute with one or more of the persons or companies registered as a literary agent or publisher or both, he or she releases RoseDog.com from claims, demands and damages of every kind connected with such disputes.
You agree to provide true and correct information about yourself when registering with RoseDog.com. RoseDog.com may disclose to third parties your sex, age, professional standing, leisure interests, zip code and city of residence, but only in the form of aggregated information that is not personally identifiable to you. In no instance will RoseDog.com disclose to third parties your email addresses, telephone number, or mailing address, except when we have your written permission, or when necessary to comply with applicable laws, police investigations, or in legal proceedings where such information is relevant. Writers are prohibited from posting personal contact information in material they post to the writers' showcase on RoseDog.com.
RoseDog.com does not guarantee uninterrupted, error-free or secure access to its services and may discontinue its operations without notice and without liability to Users. Users also indemnify RoseDog.com from all legal liability for lost or damaged files submitted by Users and destined to be posted on RoseDog.com and/ or the deletion or failure to store any messages.
Users agree not to use any devices or submit any material containing any virus or other programming routine intended to damage, detrimentally affect, surreptitiously intercept or expropriate any personal information, data or system on the site RoseDog.com. Users also agree not to impose any unreasonable or disproportionately large demand on the site's infrastructure.
RoseDog.com reserves the right to terminate the membership of and services to Users at its sole discretion and without notice. This includes but is not restricted to deletion of any content posted by the User to RoseDog.com, and may extend to cooperation with appropriate law enforcement authorities.
RoseDog makes no representations or warranties, explicit or implied, concerning the use, accuracy, quality, legality, or the results that may be obtained from use of links to advertisers, classified advertisements or the RoseDog bookstore. Users and advertisers agree to hold RoseDog harmless and not liable for any damages or losses of any type arising from such use or content and Users are encouraged to exercise caution before entering into any contractual or other type of agreement with advertisers of products or services.
Users agree to indemnify and hold RoseDog.com, its shareholders, directors, officers, representatives, successors, employees and assigns harmless from any claim or demand made by any third party arising out of their use of RoseDog.com, their violation of any of these Terms of Service, or their infringement of any intellectual property or other right of any person or entity. In the case of litigation, the User agrees that in no event shall the maximum liability of RoseDog.com exceed $50.
These Terms of Service shall be governed by the laws of the United States and the State of Washington. Both parties submit to jurisdiction in the State of Washington and further agree that any cause of action arising under this Agreement shall be brought exclusively in a federal or state court situated in the State of Washington. The Terms of Service constitutes the entire agreement between the parties and supercedes all previous written or oral agreements between the parties.
Where jurisdictions provide rights in addition to those above or do not allow the exclusion or limitation of liability for incidental or consequential damages, the above limitations may not apply or there may be provisions which supersede the above. If any provision of these Terms of Service is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced.
